The Washington Metropolitan Area Transit Authority (WMATA) is the agency in charge of our buses and subways. Our Metro subway system has a series of sensors and computers on the trains and along the tracks that are supposed
to control speed and braking. These automated systems are in place to prevent accidents like the one that happened recently.
The National Transportation Safety Board (NTSB) is a federal agency that conducts inspections of public transit systems all over the country. The NTSB warned WMATA officials about safety deficiencies in the DC area subway system in 2002, 2004 and twice in 2006. Unfortunately, the NTSB has noenforcement capabilities and is only in a position to issue warnings and recommendations, all of which were ignored by Metro officials. The reason this was the case was because the WMATA decided that the recommendations would be too expensive to implement.
Although the full account of the train crash has yet to be told, it is increasingly likely that WMATA was negligent in its responsibilities to the safety of its passengers. (For more information on understanding negligence, read our understanding negligence page.
