If you or a loved one has been taking Fosamax, and have developed complications in your upper or lower jaw, or your palate, you may have legal rights against Merck, the pharmaceutical company who manufactures Fosamax.

Merck sought and successfully received FDA approval to market Fosamax for the treatment of osteoporosis, and prophylactic treatments for post-menopausal women, and other conditions.

What can Fosamax cause?

Fosamax drugs have been linked to the catastrophic 'DEAD JAW' (Osteonecrosis of the jaw) disease. Fosamax is a drug, within a class of drugs, known as bisphosphonates. Bisphosphonates are effective in the prevention of bone resorption (the process of resorbing), and thus inhibit bone density loss. Bone resorption plays a critical role in maintaining normal bone homeostasis, in fighting infection, and in the healing process. Jaw problems can begin from such small dental procedures such as filings, root canals, etc. while taking Fosamax. Although most cases of Fosamax side effects have occurred after dental work, several cases have been reported to occur without any prior dental work.

Fosamax, whose generic name - Alendronate, is within a class of drugs known as bisphosphonates. Recently a link has been found between bisphosphonates and a serious bone disease called osteonecrosis of the jaw ('ONJ' or 'DEAD JAW'). This discovery, published in the Journal of Oral and Maxillofacial Surgeons, prompted both the U.S., Food and Drug Administration (FDA) and Novartis, a manufacturer of bisphosphonates used in cancer chemotherapy, to issue a warning to health care professionals on September 24, 2004. This warning letter contained information about bisphosphonates and the risks of osteonecrosis in the jaw.

Cases of osteonecrosis (primarily involving the jaws) have been reported in patients treated with bisphosphonates found in Fosamax. The majority of the reported cases are in cancer patients’ attendant to a dental procedure, although some oral surgeons have become convinced that oral bisphosphonates, such as Fosamax, can also cause jawbone death when taken over long periods of time. Once the necrosis (death of cells or tissues) begins, it is very difficult to treat, and it is not reversible.
