What Is Happening?
IVC (inferior vena cava) filters are implanted in patients who are at high-risk of developing blood clots. But recent studies have shown an alarming amount of IVC filter failures, sparking the FDA to release safety warnings and advisories regarding the dangers of these devices.
FDA Warns Against Long-Term Use
Many of the IVC Filter manufacturers have marketed their filters as being a "permanent" solution for patients at risk of forming blood clots. However, a number of scientific studies have shown alarmingly high numbers of complications from filters left in too long.
Because of these findings, the FDA (Food & Drug Administration) promptly issued a safety advisory to doctors that all IVC filters should be removed within 29 to 54 days of implantation.

The Medical Device Companies That Make IVC Filters May Have Known About These Serious Risks... Yet Failed To Warn Doctors and Patients
Lawsuits against IVC filter manufacturers (including C.R. Bard® Medical, Cook® and Greenfield®) allege that the IVC filters were defectively designed. New studies have shown that these filters are prone to fracturing and migrating within the body, causing the potential for serious harm.
Further, the current IVC filter lawsuits allege that the manufacturers knew of these risks with their devices, yet failed to properly warn doctors and patients of the risks and adverse consequences of long-term use.
Potentially Forged Signature -- FDA Application For Approval
There are also allegations that Bard® (the largest IVC filter manufacturer) forged a crucial signature of an in-house regulatory specialist on an FDA application meant to gain FDA approval for the IVC filter device.
NBC News reported that Kay Fuller (the regulatory specialist) stated that she never signed the FDA application for the IVC filter device because of her concerns with the device's safety. If the FDA application was forged, this would be a serious felony offense.
FDA Released Warning Letter Citing Eight Violations of Federal Law Concerning Bard's IVC Filters
Bard® (largest IVC filter manufacturer) was hit with a warning letter by the FDA (Food and Drug Administration) for violating eight federal laws concerning their IVC filters.
These violations took place at their Bard® Peripheral Vascular facility in Tempe, Arizona, as well as the C.R. Bard Inc. facility in Queensbury, NY.
The warning letter from the FDA states:
- Bard failed to correct prior violations at both facilities
- Bard failed to report device malfunction that could likely result in serious injury or death
- Bard was cited for marketing a device that was not granted marketing approval (adulterated)
- Bard misfiled several patient complaints, including the report of one patient's death

Amid the flurry of investigations and alarming new studies, the Food and Drug Administration (FDA) publicly made a statement about the risks of serious complications with IVC filter use...
“The FDA is concerned that these retrievable IVC filters, intended for short-term placement, are not always removed once a patient’s risk for PE subsides. Known long term risks associated with IVC filters include but are not limited to lower limb deep vein thrombosis (DVT), filter fracture, filter migration, filter embolization and IVC perforation.” -- FDA (Food & Drug Administration)
